Sup, I was just fooling around with the Horizon (< 3LOVE IT< 3) and I noticed some tools in it. I just wondered what would happen if you add a gamerpic but you dont have the game?:’(
No you won’t get banned .
There is always a risk of being punished if you mod your profile or games online.
Gamerpics, from my experiences, are very safe though. I have had mine set to some sort of Xbox Live “founding member” gamerpic for years and nothing has happened.

I’ve modded Gamerpics for 2 years and there has been no ban yet.
Yeah there’s always some risk of modding but for gamerpics? I have yet to see or hear anyone being banned from doing that. I’ve had my gamerpic for like a year or two already & I’m still playing lol.

No. There are many people, who are using custom pics.
I think MS doesn’t care, because if they would ban you, they would loose a customer.
If you were caught using a gamer-picture which was never available to download/purchase on the Xbox Live Marketplace then it could result in the gamer-picture(s) being revoked and your account being suspended. If you are going to use a gamer-picture, make sure that it was once available to download in the Marketplace.
I’ve done hundreds maybe even thousands on occasions and nothing has happened to me yet. 
Yes. As long was they are/were available to download on the Xbox Live Marketplace then you can certainly download and use them on your profile. However, if they were never available to download on the Marketplace, then you’re not entitled to use them.
But one more question, can you add custom pics? Like from your own computer?
Been possible for years. Haven’t heard of anything going bad.

For the custom gamerpics, no you can’t, that was patched a while ago.
