Can you get banned when adding your own Gamerpics/Themes and connecting to XBOX live?
it is possible for a ban but it all depends on what type of pics your using and if someoone reports you.
And how would you know if he bought or downloaded the picture pack/gamerpicture?

Custom gamer pics? That won’t work, and you would get banned even if it was possible. But using custom themes should be safe though.

Oh yeah totaly forgot that you have to change those tile… files via horizon to add a custom gamer pic.

you can make your own gamer pics, but they are buggy and only you can see them, though both these and the custom pic would be 100% safe
